Bicyclist's License Suspension Upheld

Saturday November 1, 2003
A New Hampshire man who was stopped while riding and bicycle and ticketed for driving under the influence failed to convince the state his bicycle should not be considered a vehicle.

Timothy Bradley, 44, admitted that he had a few drinks and the water bottle mounted on his bike contained a shot of vodka, but he denied being drunk. He refused to take a field sobriety test and his license was suspended.

Bradley's attorney told reporters his license suspension should not have been upheld because Bradley was not driving and motor vehicle and his bicycle should not be considered a vehicle under state law.

The Department of Safety however upheld the two-year suspension.
